The judge informed him that he had been charged, but Aguado insisted that the relationship was consensual. The victim said she felt very uncomfortable that night and did not consent to sex.

It is understood that Aguado claimed that the relationship with the club staff was consensual and lasted for three minutes before being interrupted when his mobile phone fell. However, the victim said she was touched while dancing and then taken to a restroom where she was sexually assaulted. The court considered forensic reports and witness statements, which supported the victim's version of events.

The case also includes messages the victim sent to friends after the incident, describing the events that night. The victim said she felt "uncomfortable, dizzy and exhausted" and did not want to dance with Aguado. Aguado said she approached him while dancing and then went to the bathroom because she felt unwell after drinking too much. The victim followed him and had consensual sex. Most witnesses said they could not remember the specifics of the night due to the amount of alcohol consumed and the passage of time.

Aguado's lawyers formally filed an appeal, claiming that the judge was biased and believed that his description of the facts was inconsistent with the victim's statement and the testimony of other witnesses. The defense also pointed out that six witnesses confirmed that they did not see any inappropriate contact when celebrating Espanyol's promotion at the Opium nightclub that night.
